Affiliate Terms & Conditions for Postpartum University

By participating in the Postpartum University® Affiliate Program (hereinafter referred to as the "Program"), you (the “Affiliate”) hereby agree to the following Terms & Conditions. You also irrevocably agree to Postpartum University’s general Customer Terms & Conditions and Privacy Policy, which are incorporated by reference into this agreement (the "Agreement"). If you do not agree to any terms within this Agreement, please do not sign up or participate in the Program. It is your responsibility to fully review and understand these terms before participating.

In the event of any conflict among these documents, the terms of this Agreement shall prevail, followed by the Customer Terms & Conditions, and finally, the Privacy Policy.

Eligibility

Affiliate must be 18 years or older to participate in the Program. Postpartum University® reserves the right to accept or reject any Affiliate at its sole discretion, or terminate an Affiliate’s participation in the Program at any time, with or without cause.

Affiliates agree to abide by all applicable laws and regulations, including those of the Federal Trade Commission (FTC), and to conduct all promotional activities with integrity and honesty.

Marketing Conduct

Affiliates are expected to maintain ethical marketing practices when promoting Postpartum University® products. Any promotional content that includes or promotes the following will result in immediate termination from the Program:

• Sexually explicit material
• Violence
• Discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
• Illegal activities
• Infringement of intellectual property, including copyrights or trademarks

Postpartum University® reserves the right to revoke Affiliate status and disqualify an Affiliate from receiving commissions, prizes, or any other compensation if marketing efforts are deemed inappropriate or in violation of this Agreement.

Spam and Unsolicited Communications

Affiliates are strictly prohibited from engaging in any form of spamming or unsolicited email practices to promote Postpartum University® products. This includes, but is not limited to:

• Sending unsolicited emails to recipients without prior business or personal relationships
• Posting unrelated content on social media platforms, forums, or message boards
• Posting comments on blogs or websites for the sole purpose of promoting affiliate links
• Engaging in any activity that violates CAN-SPAM Act guidelines or any other applicable regulations.

Violation of these terms will result in immediate removal from the Program and forfeiture of any pending commissions.

Earnings Disclaimer

Postpartum University® makes no guarantees regarding the potential earnings of Affiliates through this Program. Affiliate earnings depend on their individual promotional efforts, and Postpartum University® is not liable for any errors or interruptions in the tracking of commissions due to technical difficulties or other external factors.

Commissions

Affiliates will earn a 25% commission on each sale of Postpartum University® products directly referred through the Affiliate’s unique link during the Program. Commissions will not be paid for sales to the Affiliate themselves or for fraudulent transactions.

Commissions will be paid via PayPal once per quarter. If a sale is refunded, any previously paid commission for that sale will be deducted from future payments. Affiliates are responsible for ensuring the accuracy of their PayPal information.

Links and Promotion

Postpartum University® will provide Affiliates with appropriate links, banners, and promotional materials. Affiliates may only use their unique affiliate links on websites, social media platforms, or emails they own or manage. Posting affiliate links on unauthorized sites or spamming the internet with links is prohibited and will result in termination from the Program.

All customer data collected during the promotional period is owned by Postpartum University® and will be handled in accordance with its Privacy Policy.

Restrictions on Promotion

Affiliates may not:

• Engage in practices that create confusion between their personal sites and Postpartum University®’s official websites.
• Register or purchase domains, search terms, or keywords resembling Postpartum University®’s trademarks or those of its competitors.
• Mislead customers regarding their relationship with Postpartum University®.

Relationship of Parties

Affiliates are independent contractors, not employees or agents of Postpartum University®. Nothing in this Agreement shall be construed to create a partnership, joint venture, or employment relationship between the parties.

Confidentiality

Affiliates may not disclose any confidential information related to Postpartum University®’s business, including financial data, customer lists, or proprietary content, without prior written consent. Any breach of confidentiality will result in termination from the Program and potential legal action.

Indemnification and Liability

Postpartum University® shall not be held liable for any indirect, incidental, or consequential damages resulting from Affiliate participation in the Program. The Affiliate agrees to indemnify and hold harmless Postpartum University® and its officers, directors, and employees from any claims, damages, or liabilities arising from their promotional efforts.

Termination

Postpartum University® may terminate this Agreement at any time, with or without cause. Upon termination, the Affiliate must cease all use of Postpartum University®’s promotional materials and remove any links or branding from their websites and social media channels.

General

Failure by Postpartum University® to enforce any provision of this Agreement does not constitute a waiver of its rights. If any part of this Agreement is deemed unenforceable, the remaining provisions will continue in full effect.

By participating in the Postpartum University® Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
